General User Agreement / Public Offer — Photography Services (US)  

By booking photography services with Kseniia Elfimova trading as Kseniia Elfimova Photography (“Photographer”), you agree to the following terms:

1. Services

The Photographer will provide portrait and couples photography services as described on the website and booking form, including:

• A photography session at an agreed location and date.
• Professional editing of selected images.
• Digital delivery of final images within the standard turnaround time (subject to minor delays due to technical issues or workload).

2. Payment & Fees

• A non-refundable deposit is required to secure the session date.
• The remaining balance must be paid before or on the day of the session.
• No images will be delivered until full payment is received.

Refund Policy: All payments are non-refundable once the session has taken place. Deposits are non-refundable under any circumstances.

Travel Fee: For any sessions requiring travel of more than 40 minutes (one way) from Raymore, MO, a standard travel fee of $50 applies.

3. Data Processing & Privacy

• Personal information provided (name, email, phone, billing info, session details) will be used to manage bookings, deliver galleries, and communicate with clients.
• Data may be stored or processed using third-party service providers such as Wfolio Privacy Policy. Wfolio acts as a data processor and handles your data securely.
• You may contact the Photographer at elfimova.photo@gmail.com regarding your personal data, including requests for access, correction, or deletion.

4. Consent for Marketing & Publication of Photos

By confirming your booking, the Client grants explicit permission for the Photographer to:

• Use photographs taken during the session for portfolio, website, social media, marketing materials, exhibitions, and promotional purposes.
• Share images online or with third parties for promotional purposes.

Clients may withdraw this consent at any time by contacting the Photographer, but images already published may remain online.

Confidentiality Request: Clients who wish to keep their images fully private may request a confidentiality add-on for an additional fee ($100 for mini sessions, $150 for full sessions).

5. Usage Rights & Licensing

• Personal Use: Clients receive personal usage rights for the delivered images (printing, sharing, social media with credit).
• Commercial Use: If images are to be used commercially, a separate licensing fee applies. Clients must notify the Photographer in advance.
• Copyright: All images remain the property of the Photographer. Clients may not alter, edit, sell, or claim ownership of images.

6. Rescheduling & Cancellations

• Clients must notify the Photographer at least 2 days in advance to reschedule.
• Sessions rescheduled due to weather or unforeseen circumstances will be moved to the next available date.
• Deposits are non-refundable under all circumstances.

7. Liability & Disclaimers

• The Photographer is not responsible for unforeseen circumstances such as weather, venue restrictions, or technical failures.
• The Photographer is not liable for injuries, property damage, or loss during the session.
• Turnaround times are estimates; minor delays do not constitute breach of contract.
• Clients release the Photographer from claims arising from participation in the session.

8. Respect & Conduct

• Clients agree to maintain respectful and cooperative behavior during sessions and communication.
• Disruptive or inappropriate behavior may result in termination of the session without refund.
• The Photographer is not responsible for uncooperative behavior from children or other participants.

9. Artistic Style & Editing

• The Photographer’s work is creative and subjective; specific images, poses, or styles cannot be guaranteed.
• Selection and editing are at the Photographer’s discretion.
• Unedited RAW files are are not provided.
  

10. Right to Object

Clients or participants who do not wish to appear in public-facing images must inform the Photographer before or during the session.
The Photographer will make reasonable efforts to accommodate requests without compromising service delivery.

11. Agreement

By booking and paying for services, the Client accepts this Public Offer, agrees to all terms outlined above, and acknowledges that this constitutes a legally binding agreement for the provision of photography services in the United States.
